Welcome to Cherrybaeai.com ("Website" or "Services"), operated by SIA "TAP TECHNOLOGY", a company registered in Latvia with its registered office at Sliežu iela 29 - 9, Rīga, LV-1005, Latvia. By accessing or using our Services, you agree to be bound by these Terms of Service ("TOS") and any referenced policies available at https://cherrybaeai.com/legal/. If you do not agree, you must stop using the Services.

1. General Use

• The Services provide AI-driven virtual characters ("AI Companions") for fictional, entertainment purposes only.
• All conversations with AI Companions are simulated and should not be interpreted as real interactions.
• You may not use the Services for illegal, harmful, or commercial purposes.

2. Account Creation

• Some features require creating an account with accurate and updated information.
• You must keep your credentials secure and are fully responsible for all activity under your account.
• Accounts are non-transferable and may be terminated for violations.

3. Subscriptions & Payments

• Free users may send 10 messages, further use requires a paid subscription.
• Subscriptions renew automatically unless canceled.
• We will send a renewal reminder at least 3 days before the renewal date (as required by law).
• Tokens are non-transferable and expire at the end of each billing period.

4. Refunds & Cancellation

• You have the right to cancel your subscription at any time via email to our support team support@cherrybaeai.com.
• UK/EU users are entitled to a 14-day cooling-off period unless you start using premium features immediately, in which case the right is waived.
• Refunds outside the statutory period follow our Refund Policy:
  • Requests must be made within 24 hours, and no tokens must have been used.
  • Refunds apply only to card payments.

5. Privacy & Data Protection

• We process your personal data in compliance with the EU GDPR and our Privacy Notice https://cherrybaeai.com/privacy/
• You have rights to access, correct, delete, or restrict processing of your data.
• Data may be processed by subcontractors, but always under strict confidentiality and security obligations.

6. Content & Moderation

• Users are responsible for their inputs. AI outputs are generated automatically and should not be relied upon as factual or professional advice.
• Prohibited content includes illegal, harmful, or abusive material, including CSAM, which will be reported to appropriate authorities.
• We use moderation tools and may remove content or suspend accounts that violate our TOS.

7. Intellectual Property

• All platform content, including AI models, designs, and technology, belongs to SIA "TAP TECHNOLOGY" or its licensors.
• You receive a limited personal-use license only.
• Unauthorized reproduction, modification, or distribution is prohibited.

8. Liability Disclaimer

• Services are provided "as is" without warranties.
• We are not liable for indirect or consequential damages.
• Users must exercise judgment when interacting with AI.

9. Governing Law & Disputes

• This TOS is governed by the laws of the Republic of Latvia.
• Disputes shall be resolved by the courts of Latvia, unless mandatory consumer protection laws require otherwise.

10. Changes to Terms

• We may update these TOS from time to time.
• The revised version will be effective when posted.
• Continued use constitutes acceptance.
